Introduction

Most carriers think of a KYU number as something you just sign up for. You fill in the application, you get the number, and your trucks can run in Kentucky. For most companies, that is exactly how it goes.

But a KYU number is a license under the Kentucky Weight Distance Tax law, and Kentucky does not have to issue a license to everyone who asks. In a few specific situations, the state can refuse an application. Knowing those situations ahead of time helps you avoid delays and keep your trucks moving.

The Short Answer

Yes, a KYU application can be refused, but only for specific reasons. Under KRS 138.665, the Kentucky Transportation Cabinet shall issue a license when the application is in proper form, and the legal conditions are met.

The Cabinet may refuse a license to:

  • A person whose license was previously revoked for cause, or

  • An application that was filed as a subterfuge or not in good faith.

A carrier whose application is refused can appeal under KRS Chapter 13B.

What Kentucky Law Says About KYU Licenses

The Kentucky Weight Distance Tax applies to every motor vehicle operated on Kentucky public highways with a combined licensed weight over 59,999 pounds, under KRS 138.660(3). The tax rate is $0.0285 per mile.

To pay that tax, a carrier needs a license, which is the KYU number. The law sets three key rules:

  • A license comes first. Under KRS 138.665, every motor carrier or heavy equipment motor carrier subject to the tax needs a license before using the public highways of Kentucky.

  • Applications go through the portal. Applications are made to the Cabinet using the Motor Carrier Portal.

  • The license stays in place until it is suspended, revoked for cause, or otherwise canceled. It is not assignable or transferable.

Because the license is required before your trucks run, a refused or stalled application can keep you off Kentucky roads.

Reasons a KYU Application Can Be Refused

KRS 138.665 gives the Cabinet two grounds to refuse a license:

  1. A Previous Revocation for Cause. If your KYU license was revoked for cause in the past, the Cabinet may refuse to issue you a new one. Revocations usually follow problems such as unfiled returns or unpaid taxes. Missing quarterly returns can also lead to penalties, interest, and a $500 revocation fee, according to the Kentucky Transportation Cabinet.

  2. A Subterfuge or Bad-Faith Application. The Cabinet may refuse an application that is filed as a subterfuge or not in good faith. An example would be a company with a revoked license trying to get a new number under a different name to get around its old account.

Both reasons focus on the carrier's history and honesty, not on the size of the fleet or where the company is based.

Applications That Are Simply Not Complete

A refusal is different from an application that just isn't finished. The law says the Cabinet issues the license once the application is in proper form. If something is missing, the application can be held up even though nothing is wrong with your record.

Common causes of delays include:

  • No KYID account. The Kentucky Transportation Cabinet says first-time users must set up a KYID account before applying for a KYU number.

  • Missing vehicle information. All qualified vehicles must be listed on the account.

  • Paper applications. A mailed or emailed TC 95-1 Kentucky Trucking Application takes 10 to 14 business days to process.

What to Do If Your KYU Application Is Refused

  1. Find Out the Reason. Contact the Division of Motor Carriers and ask exactly why the application was refused.

  2. Fix What You Can. If the problem is an old account, file any missing returns and pay what is owed.

  3. Gather Your Records. Collect proof of filings, payments, and company information.

  4. Consider an Appeal. Under KRS 138.665, a refusal can be appealed under KRS Chapter 13B, Kentucky's administrative hearing law.

  5. Keep Your Trucks Legal. Do not run trucks over 59,999 pounds in Kentucky without a license or a valid temporary KYU permit.

How to Avoid Problems When You Apply

  • Apply online. The Motor Carrier Portal is faster than a paper TC 95-1 form.

  • Use correct company details. Your application should match your real business, not a new name for an old account.

  • Close old accounts properly. Keep filings up to date and select Ceased Operations on the last return when you stop running in Kentucky.

  • File every quarter. Zero-mile returns keep your account in good standing even when you don't travel.

  • Plan. Apply before your first Kentucky load, not the day the truck is ready to leave.
